Yes. And Atari owns the franchise, not necessarily the code. Aside from the fact that a major game publisher would likely never give up a franchise it paid for (even if it was useless), getting the rights to develop a new game with the I-War name doesn't get us any closer to the original source code. Atari's role will probably come down to getting their permission for somebody else to release the source.
